By placing an order with Best Plant Nursery (“we,” “us,” or “our”), you agree to the following Terms of Service. These terms outline the conditions under which we provide our products and services, as well as important information regarding shipping, returns, and guarantees. Please read them carefully to understand your rights and responsibilities as a customer.

1. Alive & Thrive Guarantee™

At Best Plant Nursery, we take pride in delivering plants that arrive healthy and ready to grow. That’s why we offer our Alive & Thrive Guarantee™. If your plants or trees arrive in poor condition, or if they fail to thrive within the first 30 days after delivery, we will provide a one-time replacement at no additional cost.

To request coverage, please contact us at [email protected] within 24–48 hours of noticing an issue. Include your order number, photos of the plant, and a description of the problem so our team can review your case. If approved, we’ll arrange a replacement or provide another resolution to ensure your satisfaction.

Please note that plants must receive appropriate care, nutrients, and an environment suitable to their growing needs. Purchases made outside of your recommended USDA growing zone, or plants that are neglected or improperly cared for, are not eligible under this guarantee. Additionally, deciduous trees purchased during winter or early spring may remain dormant until late May. If your tree has not leafed out by May 30th, you may still request a replacement, provided you contact us by that date. Photos may be required to help us troubleshoot.

2. Order Cancellations

Because we process orders quickly to ensure plants are fresh and ready to ship, all orders are finalized once checkout is complete. Your payment method will be charged immediately, and the order is fulfilled at our nursery.

If you need to cancel or make changes, you must do so within four hours of placing your order. After this period, orders may already be packed for shipment and cannot be modified. Cancellations made after processing but before shipping are subject to a 25% restocking fee. Once your order leaves our nursery, it cannot be canceled or altered.

We understand mistakes happen, and we will always do our best to accommodate your request, but because live plants require timely handling, we ask for your understanding. Please contact us at [email protected] with any urgent concerns.

3. Duplicate Orders

Occasionally, customers may accidentally place duplicate orders. While we try to catch these errors on our end, it is the customer’s responsibility to notify us immediately if this occurs. Contact us as soon as possible so we can resolve the issue before shipping.

4. Shipping

We ship orders using USPS or UPS, depending on the size and weight of your purchase. Please allow up to 72 hours for order processing before shipment. Shipping costs are calculated at checkout based on the weight and volume of your items.

We maintain a 95% accuracy rate for shipping estimates, though external factors such as carrier delays or severe weather can occasionally impact delivery. Because of this, we cannot guarantee exact delivery dates. In cases of extreme weather, we may hold shipments temporarily to protect the health of your plants, and we will keep you informed throughout the process.

5. Seasonal & Spring Shipping

Some plants are sensitive to cold and can only be shipped during warmer months. Products marked as spring-shipped on their product pages will be sent when temperatures are safe. For customers in northern states, certain items may only be available for spring shipment.

Although most plants can be planted year-round, many gardeners prefer spring or summer planting. If you would like to delay your shipment to align with your preferred planting time, please contact us at [email protected] and we’ll work with you to schedule a suitable delivery date.

6. Damaged Shipments

We take great care in securely packing every plant so it arrives healthy. However, in rare cases, shipments may be damaged during transit. If your package arrives visibly damaged, please refuse delivery so it is returned to us automatically.

If you receive a damaged plant, do not attempt to plant it, even if you think it might recover. Instead, notify us right away with photos of the damage. Our team will assist you promptly and arrange a replacement. Claims for damaged shipments must be submitted quickly so that we can address the issue effectively.

7. Payment

We accept all major credit cards as well as PayPal for online orders. Payments are processed securely using SSL encryption to protect your personal information. Orders will not be fulfilled until payment has been successfully authorized.

8. Returns

Because plants are living organisms, we cannot accept returns of live plants or trees in order to protect the health of our nursery and prevent the spread of pests or diseases. Instead, our Alive & Thrive Guarantee™ covers any issues that occur within the first 30 days after delivery.

For non-living items such as fertilizers, soil mixes, gardening tools, and containers, returns are accepted within 30 days of purchase as long as they are unused and in their original packaging. Customers are responsible for return shipping costs, and no restocking fee will apply. Please contact us before sending back any items so we can provide proper instructions.

9. Plant Dormancy & Health

Many trees and plants naturally enter a dormancy phase in fall and winter, during which they may drop leaves or appear lifeless. This is normal and helps strengthen their root systems for future growth. Claims for plant loss cannot be made until dormant plants have been properly planted and allowed time to exit dormancy in spring.

If you are unsure whether your tree is alive, you can perform a scratch test by gently scratching the bark with your fingernail. A green layer beneath means the tree is alive, while brown or black usually indicates death.

Please also note that growth rates listed on our site are estimates based on ideal conditions, and actual results may vary. Pot sizes shown refer to industry-standard nursery containers, which are smaller than traditional gallon measurements.

10. Incorrect Orders

We make every effort to ship your plants accurately. If you receive a mislabeled or incorrect item, please contact us with photos, and we will replace the item at no additional cost.

11. Bulk Orders

Bulk orders are guaranteed to arrive healthy and as described in your signed Purchase Agreement. Please note that bulk purchases are considered final sale and are not eligible for discounts, promotions, or returns.

12. Coupons & Discounts

Only one coupon code may be applied per order. Coupons cannot be combined with other discounts or offers and must be applied at checkout.

13. Mother Nature Disclaimer

While we do our best to provide the healthiest plants possible, we cannot control natural elements such as pests, extreme weather, drought, or poor soil conditions. Plants are living organisms, and their survival depends on proper care and environmental conditions. We guarantee the quality of your plants upon delivery, but we cannot guarantee their survival against factors beyond our control.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of South Carolina, USA. By using our Site, you agree to submit to the jurisdiction of state and federal courts located in York County, South Carolina for any disputes arising under these Terms.

Our liability in any case will be limited to the original purchase price of the products. If Best Plant Nursery prevails in a legal dispute, we may also recover attorney fees and legal costs.
